Anyone can send the text.
The question is whether you can prove you were allowed to.

Texting a customer you haven’t heard from in two years is legal in the UK — under the “soft opt-in” in regulation 22(3) of PECR. But it is only legal if you can still show how you got the number and that you offered a way out when you got it. That evidence is what regulators ask for, and it is the part every messaging platform leaves to you.

The fine is for the collection, not the send

In January 2026 the ICO fined a claims company £120,000 over four million marketing texts. The stated failure was not the sending — it was that the company “failed to provide individuals with an opportunity to opt-out of direct marketing at the point of obtaining the individuals’ contact details”. That moment happens in your CRM, years before any SMS platform is involved.

ICO enforcement, January 2026, as reported by RPC. A second company was fined £105,000 in the same round for not checking how a third-party list was collected.

Your platform’s terms already say this is your problem

Twilio’s messaging policy requires “prior express written consent” for anything promotional, and advises you to “reconfirm consent if a significant amount of time has passed”. It names the exact difficulty of texting an old list — and gives you no way to record, prove or keep the answer.

Quoted from the Twilio Messaging Policy, read 28 July 2026.

What we keep, and for how long

Every campaign records which numbers were screened and what came back, every STOP is stored with the message that caused it, and every campaign is classified as marketing or service — with marketing as the default, so an unclassified send gets the stricter rule, not the looser one. None of it is on a deletion timer.

Screening evidence, opt-out records and consent confirmations are excluded from our log-cleanup routine by design.
How long the evidence survives
PlatformMessage data retained
GOV.UK Notify7 days by default · 90 days maximum
Esendex6 months in-platform
TwilioConsent is your responsibility — no consent record kept
PipeIQCompliance evidence, no expiry

Sources, checked 28 July 2026: GOV.UK Notify data retention — “once the data has been deleted, we cannot retrieve it”; Esendex terms of service — “Your Data will remain available to You in the Platform for a period of 6 months”. Retention periods change; check theirs against ours before you decide. This is how our platform works, not legal advice — if you are unsure whether the soft opt-in covers your list, take advice on your own data.

It isn’t built for an industry. It’s built for a moment.

The moment you need an answer today and email is too slow to bother with. It turns up in a nightclub, a letting agency, a council depot and a school office — and the workflow underneath is the same one every time.

Nightclub & events

Friday’s half sold and it’s Wednesday.

Text the room that already turned up once. Tickets move before the doors open.

  1. Pull everyone who came to the last three events
  2. One message goes out Wednesday teatime
  3. Replies land in a single inbox, not six phones
  4. Door list updated before you open
Tickets moved before the weekend

Letting agents

Tenant reports a repair at 7pm.

The contractor is asked, answers and is booked while the office is shut.

  1. Tenant texts the repair to your dedicated number
  2. The job is put to the contractors who cover that trade
  3. First to reply takes it; the rest are stood down
  4. Tenant told, thread kept against the property
Dispatched before the office opens

Heating & utilities

Boiler down at 11pm.

One text to the on-call list finds the engineer who is actually free tonight.

  1. Out-of-hours call logs the address and the fault
  2. On-call engineers are asked in one go
  3. Whoever answers first is assigned
  4. Customer gets a name and a window
Engineer confirmed overnight

Insurance & claims

Claim’s open. Nobody’s been out.

Route the job to a trade who replies, and keep every word on the file.

  1. Claim opens and sits waiting on a site visit
  2. Approved trades on that panel are messaged
  3. The one who accepts is attached to the claim
  4. Every message timestamped against the file
Job assigned, trail intact

Comparison & quotes

They got a quote. They didn’t buy.

One text at the right moment beats a seventh email nobody opens.

  1. Quote issued, then nothing for a fortnight
  2. Screened against TPS, then one message goes out
  3. Replies are answered, not funnelled into a form
  4. Live ones handed back to the sales desk
Dead leads answering again

Builders merchants

Contractor needs a sparky by Thursday.

You already hold both their numbers. Ask one, introduce the other.

  1. Trade counter hears what the job needs
  2. Account holders in that trade are asked
  3. Available ones reply within the hour
  4. You make the introduction — both stay your customers
Sub-trade found same day

Estate agents use it too →

Residents, tenants, parents and students are lists too.

Same moment, different room. A missed bin collection, an unpaid renewal, an unexplained absence and a clearing place all have one thing in common: somebody needs an answer today, and email will not get one.

Councils & local government

Two thirds of the round don’t pay for garden waste.

Telling residents about a service they haven’t bought is marketing, not a service notification — so it needs consent, screening and an audit trail.

  1. Residents on the round with no subscription are identified
  2. Screened against TPS and CTPS before anything sends
  3. One text with a sign-up link, consent basis logged
  4. STOP handled automatically, opt-outs never contacted again
New subscribers, audit trail kept

Schools, colleges & academies

Three unexplained absences and nobody has picked up the phone.

Texting parents about attendance is one of the few interventions with a published UK trial behind it.

  1. Attendance system flags the unexplained absences
  2. Parents and carers get one personalised message
  3. They reply on the same thread — no app, no login
  4. Office picks up the replies in one place
Reasons in by morning registration

Universities & student services

Clearing opens at 8am and the phone lines melt.

Universities are explicitly outside the government’s own notification service, so this is usually being done by hand.

  1. Applicants who did not firm up are pulled off the list
  2. One text on results morning with a real number to reply to
  3. Replies triaged before they ever reach a phone line
  4. Offers, deadlines and enrolment chases run the same way
Fewer calls, faster offers

Housing associations & institutions

Contractor is on site at nine and the tenant does not know.

Also outside the government service — and running repairs, arrears and access on letters and voicemail.

  1. Appointment or arrears case is raised
  2. Tenant is texted from a number they can text back
  3. Reply confirms, reschedules or asks a question
  4. Whole exchange stays on the tenancy record
Fewer no-access visits

If you work in the public sector you should know about GOV.UK Notify, and we would rather say so than have you raise it. It gives eligible public bodies a free annual allowance of text messages for service notifications — as published on 28 July 2026, 10,000 a year for local authorities and 5,000 for state-funded schools. Check the current figures on their page, not ours. What Notify is for is set out in its own terms of use: “Only send messages related to a transaction or something the recipient has subscribed to be updated about.” PipeIQ is for everything that sits outside that sentence: reaching people who have not subscribed yet, and chargeable services where the direct marketing rules apply. There is a records problem too — Notify deletes message data after 7 days by default, 90 days at the very most, and states that once deleted it cannot be retrieved. That is not long enough to evidence a marketing consent trail. And Notify is not open to universities, housing associations or charities at all.

The Problem Every Agency Knows

Your clients do great work. But once the job's done, customers disappear — and email doesn't bring them back.

📧

"We sent the email — nobody opened it"

Email open rates for local businesses sit at 15–20%. Most of your clients' past customers never even see the message.

🔇

"They were happy but never rebooked"

Satisfied customers don't rebook automatically. Without a follow-up that gets seen, they just move on to whoever reaches them first.

💸

"We're spending on new leads instead of reactivating old ones"

Winning back a past customer costs significantly less than acquiring a new one (Harvard Business Review). Most agencies leave this revenue sitting on the table.

SMS Gets the Job Done

PipeIQ puts SMS in your agency's hands — so you can deliver real, measurable results for every client.

🛡️

Built for PECR Compliance

SMS marketing is lawful when you have consent — so PipeIQ is built around it. The platform won't let a B2C campaign go live without a declared consent basis, then adds automatic STOP opt-out handling, TPS/CTPS screening and a timestamped compliance declaration logged for every send. With serious PECR breaches now carrying ICO fines of up to £17.5m under the Data (Use and Access) Act 2025, these safeguards help your agency stay on the right side of the rules.

📱

Campaigns That Actually Get Read

SMS has a 98% open rate. Every message your agency sends gets seen — usually within 3 minutes of delivery. No spam folders. No algorithms.

Built for businesses that run on repeat work

From sole-trader plumbers to multi-client agencies — PipeIQ is designed for UK businesses where past customers are the most valuable asset.

🔧

Heating & Plumbing

Win back boiler service customers before winter

Heating engineers and plumbers lose thousands every year to unanswered calls and customers who simply don't rebook. A single SMS campaign to past boiler service customers — sent in September — fills the winter diary without a penny spent on ads.

+ 3–5 rebooked jobs from a list of 100 past customers is typical

Electrical

Turn one-off jobs into annual recurring checks

Electricians who installed consumer units, EV chargers or rewired a property 12–18 months ago have a warm list of customers who need a follow-up check. SMS gets seen. Email doesn't.

+ Annual electrical test upsells from existing customer lists

🏗️

Builders & General Trades

Referrals and repeat jobs from happy past customers

Builders who completed jobs 6–24 months ago have customers who may need extensions, renovations, or know someone who does. A short personal SMS re-opens the relationship — and the referral pipeline.

+ Referral and repeat inquiry rate increases on warm lists

📊

Marketing Agencies

Add SMS as a high-margin service line

UK agencies reselling SMS services see 30–70% gross margins. The blocker has always been compliance confidence. PipeIQ builds in the TPS screening, consent-basis prompts and Article 28 DPA automatically — so your agency can resell SMS without assembling that stack itself.

+ High-margin SMS service added to existing client retainers

Built for UK Compliance — Not an Afterthought

Most SMS tools leave compliance to you. PipeIQ has it built in from day one — so the checks happen by default, the evidence is kept, and your clients' customers are treated properly.

Common Questions

Is SMS marketing legal in the UK?

Yes, with the right consent. PECR Regulation 22 requires opt-in consent for marketing SMS (or the soft opt-in for your own existing customers). PipeIQ enforces this with consent declarations, TPS/CTPS screening and automatic STOP handling on every campaign.

Do I need my clients' consent records?

Yes — and PipeIQ makes you keep them: every campaign records the lawful basis, wording and timestamp, giving you an audit trail if the ICO ever asks.

Do I need to give my phone number to sign up?

No — your account activates and your 10 free credits are added as soon as you verify your email. You can add a mobile number later for account alerts and two-factor login.

Can I cancel anytime?

Yes. Monthly rolling, no lock-in, export your data anytime.

How is this different from Textlocal or Twilio?

Textlocal Messenger closes on 31 July 2026. Twilio gives you a raw SMS pipe; PipeIQ is the full agency workflow — per-client dedicated UK numbers, built-in compliance screening, Aria voice agent for inbound calls, and replies managed in one dashboard. No dev work required.

What is Aria and do I need it?

Aria is PipeIQ's built-in AI voice agent. She answers inbound calls 24/7, qualifies callers, books appointments, and sends SMS confirmations — automatically. You don't need to configure anything. If you have a dedicated UK number on the Business plan, Aria is available for inbound calls to that number.
