Texting a customer you haven’t heard from in two years is legal in the UK — under the “soft opt-in” in regulation 22(3) of PECR. But it is only legal if you can still show how you got the number and that you offered a way out when you got it. That evidence is what regulators ask for, and it is the part every messaging platform leaves to you.
In January 2026 the ICO fined a claims company £120,000 over four million marketing texts. The stated failure was not the sending — it was that the company “failed to provide individuals with an opportunity to opt-out of direct marketing at the point of obtaining the individuals’ contact details”. If you work in the public sector you should know about GOV.UK Notify, and we would rather say so than have you raise it. It gives eligible public bodies a free annual allowance of text messages for service notifications — as published on 28 July 2026, 10,000 a year for local authorities and 5,000 for state-funded schools. Check the current figures on their page, not ours. What Notify is for is set out in its own terms of use: “Only send messages related to a transaction or something the recipient has subscribed to be updated about.” PipeIQ is for everything that sits outside that sentence: reaching people who have not subscribed yet, and chargeable services where the direct marketing rules apply. There is a records problem too — Notify deletes message data after 7 days by default, 90 days at the very most, and states that once deleted it cannot be retrieved. That is not long enough to evidence a marketing consent trail. And Notify is not open to universities, housing associations or charities at all.
