Can you text customers and on-call engineers?

A message about a job in progress — an engineer allocated, an arrival window, an access request — is a service message, not marketing. Where you text customers to promote something, such as an annual service plan, PECR Regulation 22(3) soft opt-in applies and four conditions must be met.

⚠ The four conditions for lawful soft opt-in (PECR Reg 22(3))
  1. Number collected during an enquiry or job. The customer gave you the number when they called you out or bought cover — not from a bought list.
  2. Promotional messages are about similar services. Servicing, cover renewals and safety checks are similar services. Unrelated offers are not covered by soft opt-in.
  3. Opt-out offered at the point of collection. When the job is booked or the cover is sold, the customer must be given a clear way to decline future marketing texts.
  4. Opt-out on every promotional message. "Reply STOP to opt out" on every marketing text. Live job updates are a separate category.
