Where does SMS sit for claims work?

Messages about a live claim are service communications, not marketing, and the marketing rules are not what governs them. Where you text to promote — renewals, additional cover — PECR Regulation 22(3) soft opt-in applies and four conditions must be met.

⚠ The four conditions for lawful soft opt-in (PECR Reg 22(3))
  1. Number collected during a sale or negotiation. The policyholder gave you the number buying the policy or notifying the claim — not from a purchased list.
  2. Promotional messages are about similar services. Renewals and related cover are similar services. Unrelated products are not covered by soft opt-in.
  3. Opt-out offered at the point of collection. At policy purchase or first notification of loss, there must be a clear way to decline marketing texts.
  4. Opt-out on every promotional message. "Reply STOP to opt out" on every marketing text. Claim-progress messages are a separate category.
