Can you text your trade account holders?

Corporate subscribers — limited companies and LLPs — sit outside PECR's SMS marketing restriction, but most tradespeople are sole traders or partnerships, who are protected in the same way as individuals. The safe operating rule is to treat every number as protected and rely on PECR Regulation 22(3) soft opt-in, which needs four conditions.

  1. Number collected during a sale or negotiation. They gave it opening a trade account or placing an order — not from a trade directory.
  2. Messages are about similar products and services. Your stock, your deals, your branch. Introductions between account holders sit alongside that; do not stretch it to unrelated marketing.
  3. Opt-out offered when the account was opened. The trade account form must carry a clear way to decline marketing texts.
  4. Opt-out on every message. "Reply STOP to opt out" on every text.

On referrals, one extra point: passing a contractor's number to another account holder is sharing personal data. Ask first — a reply saying yes is a record of that consent, which is why the referral message above asks rather than assumes.
